Panel 2. “New Developments in International Investment Arbitration“

The Croatian Arbitration Days is one of the most respected conferences in Central and Eastern Europe in the field of arbitration. It is organised by the Permanent Arbitration Court of the Croatian Chamber of Economy (PAC CCE). For the first time in its unique tradition, after 27 years since 1992, instead of its traditional format of a two-day event, the Conference will be held in remote mode, as a one-day virtual conference with two webinars: Panel 1: “Arbitral hearings during the pandemic period” (in Croatian) and Panel 2: “New developments in international investment arbitration” (in English). 

Objective:

This webinar will explore the latest developments in international investment arbitration. It will  open with  a first-hand overview of UNCITRAL’s current work on expedited arbitration and the reform of investor-State dispute settlement (ISDS), followed by an update on the progress made by the UNCITRAL WG entrusted to work on ISDS reform and the challenges which the group is facing. One avenue of the reform process might be a systemic ISDS reform, which would include, as one of its pillars, the Multilateral Investment Court that will be discussed at the webinar. In addition to topics dealing with the investment dispute settlement mechanism, the webinar will focus on the burning issue in the field of international investment arbitration, i.e. the repercussions of the landmark Achmea judgment of the European Court of Justice (ECJ). The webinar will conclude with a discussion on how respondent States, in casu Croatia, reply to one of the most often breaches of BITs invoked by foreign investors, violation of their legitimate expectations. 

Who should attend:

The webinar is intended for government officials, in-house lawyers of State enterprises, arbitrators, counsels representing investors and States, academics interested in and/or involved, representatives of non-governmental organizations and all other stakeholders in international investment arbitration who would like to obtain further knowledge and keep up to date on the latest developments and reform processes in the field of international investment arbitration.
